Prison officials are asking a judge to toss out a lawsuit filed by Oklahoma City bombing conspirator Terry Nichols over prison food.
Nichols has complained about the lack of whole grains and fresh food in the prison diet, and says it violates his religious beliefs
His lawsuit filed in March claims Jews and Muslims are provided with special food in prison, and so should he.
But prison officials say Nichols hasn't demonstrated how his diet burdens his Christianity.
Lawyers with the U.S. Attorney's Office also say that Nichols hasn't made a plausible claim over the food at the federal Supermax prison in Colorado.
Nichols is serving life for conspiracy and involuntary manslaughter in the 1995 federal building bombing that killed 168 people. Timothy McVeigh was convicted of murder and executed.
