Previously sworn, testified further as follows:
Direct Examination By Mr. Ranes:
Q Again, please state your name for the record.
A Jason Robert Scott
Q Jason, I would like to ask you some questions regarding some people and whether you know then. Do you know Gary Scarff?
A yes, I do.
Q And how long have you known him>
A I would say about a year and a half.
Q And where did you meet him?
A Oklahoma
Q Oklahoma City?
A Mm-hm (affirmative)
Q And that was the first time you met him correct?
A (Witness nods head affirmatively)
Q You have to answer out loud.
A Yes
Q In fact, when you went to Oklahoma City you went there for several days; correct?
A Mm-hm (Affirmative)
Q And where did you stay?
A I don't remember the motel.
Q Was it the Marriott motel?
A I don't remember.
Q And in fact, you shared the same room with Gary Scarff; didn't you?
A Yes.
Q And how did you get there?
A How did I get to the motel?
Q Yeah, How did you get to Oklahoma City?
MR. FULLER: Your honor, I object. I don't think that this part of it is relevant.
THE COURT: Objection is sustained.
Q (By Mr. Ranes continuing) How long did you share the same room with Garry Scarff?
A Four days.
Q And during that time did you have discussion with Garry Scarff regarding the facts of this case?
A Yes.
Q And, in fact, you told Garry Scarff over the next several days what had occurred between January 18th and January 23rd; didn't you?
A Yes.
Q And while you were there you also met with other individuals; correct?
A Yes.
Q Do you know a David Butterworth?
A Yes.
Q And how long have you known him?
A A year and a half.
Q Did you meet him in Oklahoma City as well?
A Yes.
Q What about Ann Loss (ph.)? Do you know her?
A Yes.
Q And did you meet her in Oklahoma City?
A Yes.
Q And Kathy Norman? Do you know her?
A Yes.
Q And where did you meet her?
A Oklahoma City.
Q What about Andrew Bagley?
A I don't remember him.
Q You don't remember meeting him in Oklahoma City?
A Hm-mm (negative)
Q What about George Robertson?
A Yes, I know him.
Q And how long have you known him?
A Almost three years.
Q So you knew him prior to going to Oklahoma City; didn't you?
A Yes.
Q And he was in Oklahoma City with you; wasn't he?
A Yes.
Q And what about Sue Taylor? Do you remember her?
A The name is familiar, yes.
Q You don't remember meeting her?
A Her face doesn't come to mind.
Q In fact, do you remember during the four days that you were at the Marriott, being in a room with all of those individuals at one time?
A Yes.
Q And isn't it true that several of those individuals were coaching you in regard to the testimony that you would give in this case.
A That's not true. No one has ever coached me on my testimony. My testimony has remained the same for three years.
Q Your testimony has remained the same for three years?
A Mm-hm (affirmative)
Q Did David Butterworth suggest to you that you needed to spice up your testimony?
A Not one - he didn't hint it one bit.
MR FULLER: Now, your Honor, I am going to object at this point. I don't think that question is relevant; the question that Mr. Ranes needs to lay for the foundation has already been asked.
THE COURT: Objection sustained.
Q (by Mr. Ranes, continuing) So, your testimony is that none of the advised that I mentioned to you ever coached you during the time you were in the Marriott Hotel, in Oklahoma City?
A That is true.
Q I would like to ask you some questions regarding a trip on the way back from McMinneville, Oregon.
MR FULLER: Now, your Honor, I do object to that. I think this is beyond the scope of what we talked about.
THE COURT: One moment, please. Can you refer to me a paragraph number?
MR. RANES: Yes, your Honor, I'm referring to Paragraph 24 and 25.
THE COURT: The objection is sustained.
MR. FULLER: I'm sorry your Honor? That was sustained?
THE COURT: Yes.
