Re: Jason Scott kidnapping/ False Imprisonment
Dear Joe,
Thank you for your update on the above-referenced prosecution. I was pleased to hear that the deposition of your state's witness went well and that you are expecting the court reporter's transcript by this Friday.
Per our telephone conversation, I will call you again on the afternoon of June 30, in the hopes of hearing that the information has been finalized and sent out for service on Rick Ross as discussed.
For your information, enclosed is a copy of a recent article in the Barrington Courier of the conviction of Galen Kelly, another deprogrammer affiliated with CAN, which I thought would be of interest to you.
Thank you again for your professional courtesy in this matter.
Sincerely,
BOWLES & MOXON

Re: Jason Scott kidnapping/False Imprisonment
Dear Joe:
I have some very good news for you. In a case similar to Jason's, nationally known deprogrammer Galen Kelly was just convicted on charges of kidnapping in the U.S. District Court in Alexandria, Virginia. I have attached some of the media stories on this for your information.
In the Kelly case, the victim, Debra Dobkowski, was abducted in May 1992 and dragged into a van where the kidnappers took her to a location where they intended to deprogram her. This was similar to what was done to Jason, when he was dragged into the van, duct tape was put over his mouth, and he was taken to a remote cabin where he was handcuffed and held against his will for five days. However, Galen Kelly and the other kidnappers abducted the wrong woman, they had intended to kidnap Ms. Dobkowski's roommate.
The case went to trial on May 24, 1993. On May 27, Galen Kelly was convicted on charges of kidnapping. He is currently in jail, and I understand that he faces a minimum of 6 years imprisonment, and that he could serve life imprisonment.
In my opinion, the Kelly conviction represents the prevailing attitude in the U.S., of the utter unacceptability of attempting to force an individual away from his religious beliefs in violation of his First Amendment rights.
In light of this conviction, it seems prudent to move forward as quickly as possible and take advantage of the momentum. I strongly urge you to consider filing the Information against Rick Ross immediately so as to ride this media momentum.
You may wish to contact the prosecutor in the Galen Kelly case directly. His name is Larry Leiser, Assistant U.S. Attorney, Eastern Division of Virginia. His phone number is (703) 706-3700.
This looks like an excellent opportunity to push forward with the Rick Ross prosecution. I hope to hear from you soon.
Sincerely,
BOWLES & MOXON

Re: Kidnapping/False Imprisonment of Jason Scott
Dear Joe,
I am writing to acknowledge receipt of your phone message of a few days ago. I am sorry that you are having back problems and I wish you a speedy recovery. I myself have lower back problems and fully appreciate your condition.
The last word that I had on the status of the Rick Ross Information was that you were awaiting the declaration from one of the witnesses. Have you received that declaration? If so, have you served Mr. Ross with the information?
Again, wishing you a speedy recovery. Please drop me a line when your condition permits.
Sincerely,
BOWLES & MOXON

Re: Kidnapping/False Imprisonment of Jason Scott
Dear Mr. Menefee,
This firm represents Jason Scott in connection with the above referenced matter. I am writing to you as I am hoping to determine the status of the prosecution of this case.
I have been unable to reach Mr. Wheeler over the past few weeks, since I submitted a summary of the kidnapping incident, and therefore, I am forwarding this to you in the hopes that his case can be rapidly resolved.
As detailed in my summary, which I have enclosed for your convenience, there is a great deal of evidence supporting a conviction of the kidnappers in this case, including eyewitnesses and a victim who wants to go forward with the prosecution.
I would greatly appreciate it if you could get in touch with me to inform me of the status of this matter.
Sincerely,
